Negative and Positive Rights: Generations of Rights

Thinkers have developed ways to classify rights. One distinction is between 'negative' rights, which require others, especially governments, to refrain from interfering, such as freedom of speech, and 'positive' rights, which require action or provision, such as education or health care. Philosopher Isaiah Berlin's 1958 lecture 'Two Concepts of Liberty' sharpened a related debate between freedom from interference and freedom to achieve one's goals.

In 1977 the jurist Karel Vasak proposed three 'generations' of rights, loosely linked to the French revolutionary slogan: first-generation civil and political rights (liberty), second-generation economic and social rights (equality), and third-generation collective rights such as development and a healthy environment (fraternity). Critics point out that the categories blur: even a fair trial requires state spending on courts, and the generations metaphor may wrongly imply some rights are older or more important.

These frameworks are tools for thinking, not rigid boxes, and help explain arguments about which rights governments must prioritize.
